Dwelling Action

When a homeowner sues the people who built or sold a home over an alleged construction defect, Arizona law has a specific name for that lawsuit: a dwelling action. The term comes from the Purchaser Dwelling Act in Arizona Revised Statutes Title 12. A.R.S. 12-1361 defines a dwelling action as a court proceeding or arbitration by a buyer against the seller, builder, developer, or contractor over a defect in the design, construction, or sale of a dwelling.

What makes a dwelling action special is that the homeowner cannot simply file suit. The Act, in A.R.S. 12-1362 and the surrounding sections, requires the owner to first send the builder written notice describing each claimed defect, then give the builder a chance to inspect and to offer to repair, replace, or pay. Only after that notice-and-opportunity-to-repair process plays out can the dwelling action proceed in court. Skipping the notice can get the case delayed or dismissed.

For example, if a homeowner in Buckeye discovers recurring stucco cracks and a leaking window two years after move-in, the formal path is a dwelling action under the Act: serve the written defect notice, allow the inspection, and see whether the builder offers a fix before any court filing. The statute defines the choreography.

A dwelling action is the lawsuit; a construction defect is the underlying problem that the lawsuit is about. The two terms are related but not identical. A dwelling action is also bounded in time by Arizona's statute of repose (A.R.S. 12-552), which caps how many years after the home is finished a claim can be brought. Understanding both is the difference between a claim that proceeds and one that is barred.
