UL 9540

UL 9540 is UL Solutions' Standard for Energy Storage Systems and Equipment. It is a system-level listing, which is the part people miss. A cell can hold its own certification and still leave the finished product unlisted, because UL 9540 judges the assembled unit: cells, power conversion equipment, controls, cooling, and the enclosure it all lives in. A Powerwall or an Enphase battery carries the mark as one product.

Section R328 of the 2021 International Residential Code makes that listing the price of entry: a home battery has to be listed and labeled to UL 9540 before it goes in. From there the section sets sizes. One unit tops out at 20 kWh. The total allowed indoors, in a utility closet, basement, or storage room, is 40 kWh, and a garage, exterior wall, or ground mount allows up to 80 kWh. Units sit at least 3 feet apart.

UL 9540A is a different animal, and conflating the two is the common error. It is a test method, titled Test Method for Evaluating Thermal Runaway Fire Propagation in Battery Energy Storage Systems. Nothing is ever UL 9540A listed, because the test produces a report, not a listing. What that report buys is relief: R328 lets units sit closer than 3 feet, or in larger totals, when the report documents the tighter arrangement is safe.

For example, a Fountain Hills home pairing rooftop solar with two garage-wall batteries clears both caps easily, since a garage allows 80 kWh. Setting them closer than 3 feet is the part that needs paper, and only the maker's UL 9540A report buys it. The other Arizona catch is the code edition. R328 is new in the 2021 IRC and did not exist in the 2018 edition, and Arizona cities are split between the two. In a city still on 2018, the UL 9540 label plus NFPA 855 and the maker's instructions carry the review, so ask your AHJ which edition it enforces before you buy.
